By using EvidenceDesk AI ("Service," "we," "us," or "our") at evidencedeskai.com, you ("User" or "you") agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

We reserve the right to modify these terms at any time. Continued use of the Service after changes are posted constitutes acceptance.

2. Service Description

EvidenceDesk AI provides document organization services only. We use AI to extract, sort, and structure information from case documents you upload into organized outputs including timelines, evidence indexes, witness charts, contradiction charts, missing-document checklists, and attorney question lists.

We do not provide:

• Legal advice, legal strategy, or legal opinions
• Court representation or filings
• Communication with prosecutors, courts, or opposing counsel
• Predictions about legal outcomes
• Public records request services (we provide templates and guidance only)

3. Not a Law Firm — No Attorney-Client Relationship

EvidenceDesk AI is not a law firm. No attorney-client relationship, fiduciary relationship, or professional relationship of any kind is created by using this Service. Nothing in any output, communication, or document produced by EvidenceDesk AI constitutes legal advice.

You must consult a licensed attorney for legal advice. Never rely solely on AI-generated summaries for legal decisions.

4. AI Output Disclaimer

Our AI-generated outputs — including timelines, summaries, contradiction charts, and evidence indexes — may contain errors, omissions, misinterpretations, or inaccuracies. AI language models do not guarantee factual accuracy.

All outputs must be reviewed by a licensed attorney before use in any legal context. EvidenceDesk AI is not responsible for any reliance on AI-generated content without attorney review.

5. User Responsibilities

By using the Service, you represent and warrant that:

• You are at least 18 years of age
• You have the legal right to upload and share the documents you provide
• You will not upload documents you are legally prohibited from sharing
• You will maintain your own copies of all original documents
• You will have all AI-generated outputs reviewed by a licensed attorney before use
• You will not use the Service for any unlawful purpose
• You understand this is a document organization service, not legal representation

6. Payment and Fees

Service Fees

Service fees are listed on our website and are due at the time of checkout via Stripe. Prices are subject to change. The fee shown at checkout is the fee you pay.

Pass-Through Fees

Government fees for obtaining public records (police reports, bodycam footage, 911 audio, court records, etc.) are not included in our service price. These fees are charged by government agencies and paid directly by you. We will provide guidance on expected fees but cannot predict them with certainty.

Rush Processing

Rush processing add-ons are available for cases with imminent court dates. Rush fees are non-refundable once processing has begun.

Refunds

Refunds are available only if we are unable to deliver your packet due to a technical error on our part. No refunds are issued after your packet has been delivered. If you are dissatisfied with your packet, contact us within 7 days of delivery to discuss corrections.

7. Data and File Retention

• Raw uploads: Automatically deleted 14 days after final delivery. You are responsible for maintaining your own copies.
• Final packets: Automatically deleted 30 days after delivery.

We are not responsible for any loss of documents after the retention period expires. Download and save your packet immediately upon delivery.

8. Confidentiality

We treat your case documents as confidential and will not disclose them to third parties except as required to operate the Service (see our Privacy Policy). We do not use your case documents to train AI models. Case documents are processed solely for the purpose of generating your packet.

9. Intellectual Property

You retain all rights to the documents you upload. By uploading documents, you grant EvidenceDesk AI a limited license to process those documents solely for the purpose of generating your requested packet.

The EvidenceDesk AI website, brand, and software are owned by us and are protected by copyright and other intellectual property laws.

10. Limitation of Liability

To the maximum extent permitted by applicable law, EvidenceDesk AI and its owners, operators, employees, and agents shall not be liable for:

• Any indirect, incidental, consequential, or punitive damages
• Any legal outcomes resulting from your use of AI-generated outputs
• Errors or omissions in AI-generated summaries or timelines
• Loss of data after the retention period
• Third-party fees (government, court, agency)
• Any delays in document processing beyond estimated turnaround times

Our total liability to you for any claim arising from the Service shall not exceed the amount you paid for the specific service giving rise to the claim.

11. Indemnification

You agree to indemnify and hold harmless EvidenceDesk AI and its owners, operators, and agents from any claims, damages, or expenses (including reasonable attorney fees) arising from your use of the Service, your violation of these Terms, or your upload of any document you did not have the right to share.

12. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to conflict of law provisions. Any disputes shall be resolved in the courts of the State of Florida.
